Procès BDS Perpignan : une nouvelle victoire !

La Campagne BDS France se félicite de la décision de justice rendue ce mercredi 14 août par le Tri­bunal de Grande Ins­tance de Per­pignan qui relaxe les accusés.

Après trois ans de procédures et de reports, Jeanne, Yamina et Bernard, poursuivis par des officines du lobby pro israélien en France, comme   le « Bureau National de Vigilance contre l’Antisémitisme » (BNVCA) ont été jugés sur le fond le 20 juin dernier pour « incitation à la haine, à la discrimination, et à la violence  » suite à une action Boycott- Désinvestissement – Sanctions auprès des consommateurs du magasin Carrefour de Perpignan, les appelant au boycott des produits exportés par Israël, dénonçant la colonisation au travers des produits issus des colonies illégalement commercialisés par Israël.

Une centaine de personnes (dont une délégation d’Alençon) s’est retrouvée ce 14 août devant le Palais de justice pour le rendu du jugement.

Le tribunal a constaté:

  • la nullité de la citation concernant les discours et les écrits (les discours et les écrits incriminés ne sont pas précisés),
  • la relaxe concernant les affiches et les imprimés en raison de défaut d’élément matériel (rien qui ne ressemble à une provocation à la discrimination, la haine ou la violence ou à une entrave à l’exercice d’une activité économique).

C’est une nouvelle victoire pour le mouvement de solidarité qui depuis trois ans apporte son soutien à nos trois camarades et bien entendu pour la Campagne BDS.

C’est un message à ceux qui nous ont accusés, ils ne feront jamais taire notre solidarité au peuple palestinien en tentant de criminaliser nos actions militantes.

Nous saurons dans 10 jours, si les parties civiles ou le parquet font appel.

Les nombreuses décisions de justice rendues jusqu’ici  (Mulhouse, Paris, Bobigny…)  sur ces fausses affaires  reconnaissent toutes  que  les militants  qui s’inscrivent dans l’appel du Boycott Désinvestissement Sanction  n’ont rien à voir avec le racisme ou la haine. En réalité ils  luttent par des actions citoyennes et pacifiques contre l’impunité de l’Etat d’Israël, et  ses innombrables violations des droits humains et du droit international.

Il est  temps aujourd’hui  que la ministre de la justice prenne acte de l’inanité de la circulaire dite « Michèle Alliot Marie » qui n’était qu’une tentative du gouvernement précédent d’instrumentaliser la justice au profit d’une cause politique.

Pour que la  justice puisse être rendue sereinement et pour que les actes véritablement racistes soient sanctionnés sans amalgame avec une légitime action citoyenne, cette  circulaire doit être abrogée.

Les tribunaux français viennent de le rappeler à nouveau, le boycott d’Israël est légal.

La prochaine décision pour un procès BDS sera rendue le 19 Septembre à Alençon, ou sept autres militant-es sont également poursuivis.

Plus que jamais la campagne BDS pour l’isolement politique de l’état d’Israël doit continuer et se renforcer jusqu’à ce que justice soit enfin rendue au peuple palestinien.

BDS trial in Perpignan: another victory!

The BDS French Campaign welcomes the legal verdict handed down on 14 August by the Perpignan high court, acquitting the three accused activists.

After three years of procedures and postponements, Jeanne, Yamina and Bernard were tried on 20 June 2013 for “inciting hatred, discrimination and violence”, a charge brought by various agencies of the pro-Israel lobby in France, such as the “National Bureau of Vigilance against Antisemitism”.  The charge followed a Boycott-Divestment-Sanctions action carried out at the Carrefour supermarket in Perpignan, denouncing the colonisation and calling upon customers to boycott goods illegally produced in the colonies and exported by Israel.

Some 100 supporters, including a delegation from Alençon, gathered today outside the court to hear the announcement of the verdict.

The court ruling:

– The charge relating to statements made in a public place and to printed materials was ruled invalid by the court.  The nature of the statements and materials was not specified.

– The defendants were acquitted of the charges relating to the posters displayed and the leaflets distributed to the public, due to the lack of any material evidence indicating an incitement to discrimination, hatred or violence, or indicating a hindrance to the exercise of economic activity.

This is another victory for the solidarity movement that has for the past three years given its support to our three friends, and it is of course yet another victory for the BDS Campaign.

It sends a message to our accusers that they will not silence our solidarity with the Palestinian people by attempting to criminalise our activism.

We shall learn within ten days if the plaintiffs or the public prosecutor intend to appeal the verdict.

The many legal verdicts previously pronounced (e.g. in Mulhouse, Paris, Bobigny…), following similar unfounded charges, have all recognized that those who support the BDS appeal have nothing to do with racism or hatred.  They are part of the peaceful, people’s movement against the impunity of the State of Israel and its countless violations of human rights and international law.

It is now time for the current Minister of Justice to acknowledge the absurdity of the so-called “Alliot-Marie circular”, which was nothing more than an attempt by the previous French government to instrumentalise the law for political ends.  That circular must be annulled in the name of justice and so that citizens’ legitimate actions not be conflated with punishable acts of real racism.

This latest verdict by the French court has reaffirmed that the boycott of Israel is legal.

The verdict regarding the court case against seven other activists in Alençon will be handed down on 19 September.

Now more than ever, the BDS campaign for the political isolation of the State of Israel must be pursued and strengthened until the day when the Palestinian people finally obtain justice.
